After a long delay in the Maxwell Wyant murder case, jurors heard some strong testimony from a witness who took the stand Friday afternoon. Wyant is charged with second degree murder in the death of his former roommate.
Sandy Smith says just a weekend before CJ Schoen was shot and killed, she was at Max Wyant's house. She testified that's where she heard Wyant say he wanted his former roommate dead.
Smith took the stand Friday afternoon. She testfied she was CJ Schoen's friend and often visited the Brighton home he once shared with Wyant. Even after Schoen moved out, Smith said she went to the house to visit other friends who lived there.
Smith says during one of her last visits, the weekend just before Schoen was killed on February 8th, Schoen's name came up in conversation. Smith said Wyant went into a rage, saying he hated him. She said Wyant said, "if he ever stepped foot on the property again, he’d kill him.”
"It's not damaging at all. This day and age, people say they're going to kill people as a colloquialism all the time,” said James Nobles, defense attorney. “And I also anticipate there's going to be testimony that directly controverts directly what she said; that that conversation did take place but it was no big deal and no one was offended by it or scared by it."
Prosecutors say the day of the shooting; Schoen had gone to his former home to retrieve something he had left behind when he moved out.
Wyant is charged with second degree murder in connection to his death.
Friday, jurors got a chance to see video of the home where all of this happened.
Brighton Police crime scene technicians, who went through the house, testified that they found several guns, swords, a grenade, and hundreds of spent casings on the floor. One officer indicated the basement looked as if it were used for target practice.
Testimony in the case really only got underway Friday afternoon. Judge Doug Randall closed the courtroom and spent the morning dealing with a jury issue. An alternate juror was excused.
Testimony is expected to continue Monday morning.
