NEW YORK CITY, N.Y. -- All eyes Wednesday were on Karla Giraldo, the alleged victim in Hiram Monserrate's assault trial. Giraldo has not been cooperating with prosecutors, but was subpoenaed to appear as a prosecution witness Wednesday and delivered dramatic testimony, breaking down in tears at one point, but ultimately backing Monserrate's claim the whole thing was a freak accident.
Giraldo began crying and had to be briefly excused when shown this surveillance video from Monserrate's apartment building, telling the judge it made her ill. But later, asked why she appeared to ring a neighbor's doorbell, Giraldo said she was drunk, panicky and acting confused. The prosecution said that contradicted her earlier testimony to a grand jury, when Giraldo said she wasn't drunk and that she thought a neighbor could help her get to a hospital.
Speaking through a Spanish interpreter, Giraldo was often combative in her testimony. She objected to some of the prosecutor's questions and said she didn't trust the prosecution and that she's felt harassed throughout the whole process.
Monserrate is accused of slashing Giraldo in a fit of jealous rage after finding another man's business card in her purse. Prosecutors say Giraldo told hospital staff it was no accident, only to later change her story. But Giraldo said Wednesday she didn't recall making those statements and that hospital staff couldn't understand her through the language barrier. And she said Monserrate wasn't angry when he found the card, which surveillance video shows him throwing down a garbage chute.
If convicted, Monserrate faces up to seven years in prison and would have to surrender his Senate seat.
