Teen Pleads Not Guilty in Deadly DWI Crash
A Greece teen facing DWI and vehicular manslaughter charges pleaded not guilty at her arraignment Monday.

Police say Tia Gerstner, 18, was driving drunk on Ling Road in late March when she lost control of her car.

Gerstner's classmate and friend Joseph Mueller, 17, died in the crash. Prosecutors say Gerstner's blood alcohol level was .11 at the time of her arrest.

"I will put the facts I know before the jury and ultimately it will be up to a jury or judge if she wishes to makes those determinations," said prosecutor Perry Duckles. "There was a blood test regarding the alcohol and drugs and that will be the evidence we will put before a jury when that time comes."

“She is definitely upset by everything that has transpired," said defense attorney Joseph Damelio. "She truly can appreciate the gravity of this situation that a young man has lost his life and there isn’t a day that goes by that she doesn’t feel that."

The judge gave Gerstner a curfew; she has to be at home between 10 p.m. and 7 a.m. She is also not allowed to drive.

Gerstner is due back in court Friday morning.
