One of the drivers accused in the alleged DWI crash that killed a popular Fairport teacher was back in the courtroom Wednesday morning.
The vehicular manslaughter case of Megan Merkel, 23, will now be heard by a Monroe County grand jury.
Deputies say Merkel was driving drunk July 29th when she ran over Heather Boyum, 40, on Route 250 in Penfield.
Police say Boyum was lying in the road after being struck by a motorcycle driven by Merkel's boyfriend, Mark Scerbo.
Scerbo is facing second degree manslaughter charges from the crash. His case is also being heard by a grand jury.
