The New York State Division of Parole tells YNN that it could happen as early as December 19th.

Rahn appeared before the parole board last week, and the board issued its decision Tuesday.

In July 2010, Rahn was sentenced to up to five years in prison. He was convicted of falsifying a background check for former officer Gary Pignato and trying to cover up a DWI hit-and-run crash involving former Sergeant Nick Joseph.

On Tuesday, Rahn's defense attorney, John Parrinello, said that Rahn's parole will be the true justice in the case.

"He's gonna move on with his life. Merritt is a glass half-full, not a glass half-empty. Merritt will come back, he's got many many supporters, many people who love him in this community. Never stepped out of line in the line of duty, and that conviction was just, as I said, politically-motivated," Parrinello said.

To date, Merritt Rahn has served 28 months of his sentence. He will be under supervised parole for 2½ years.
