NYSUT has long been opposed to the two percent tax cap, saying it's hurting education in some of the state’s poorer school districts. Under the law, sixty percent of voters in school districts have to approve a budget that goes over the two percent cap.

The union argues this is unconstitutional because it limits the amount of local control districts and taxpayers have. They also say it violates the constitutional principle of one person, one vote because those voting for going over the cap have less voting power than those voting against it.
