A Monroe County Crime Lab forensic biologist who took the stand testified she examined fluid from the baby and the baby's diaper. She says she found sperm in both.

A State Police forensic scientist from a lab in Albany took the stand next. He testified those sperm samples were found to be consistent or a match to Richard Dallas.

Earlier in the day, Wayne County District Attorney Rick Healy brought Lyons police officer and State Police investigators in to testify the evidence, including those DNA samples, had never been out of police custody or unsealed at any time.

Healy says DNA plays a big part in this case.

“This is really the evidence that establishes that this was a sex crime. That’s his DNA or his sperm involved with this child. That’s as strong, strong evidence as we can have,” Healy said.

This ends Day Two of testimony in a case that even experienced law enforcement officers say has been difficult to be involved with.

Dallas is accused to raping a baby girl he had been taking care of on November 30. The baby had such severe injuries, including a lacerated colon, that Healy said she would've died without medical care.

Dallas' attorneys say he is not guilty. His family said they were in court to support him.

The baby's mother who we are not identifying says her daughter is doing better, but still has some health issues. The baby is in foster care.

The case is expected to continue Thursday and the judge could have a decision by the end of the week.
