A Monroe County Court judge will rule next month whether statements Bobbie Kugler made to police can be admissible at her upcoming trial.

Kugler is charged with murder, manslaughter, assault and arson in connection with a February fire at her Grape Street home that claimed the lives of three of her children and injured three other people.

Kugler's defense team argues statements Kugler made to Rochester police investigators at her apartment in Poughkeepsie be supressed. They claim police used deceptive techniques in their questioning, and that Kugler may have been in an unstable condition after being hospitalized for a suicide attempt.

"My recollection of the testimony is the officers said she was responsive, she did get out of the hospital, she answered the questions that were asked, she did not appear to be intoxicated, she did not appear to be under the influence of any drugs, she never complained of any illness or injury and she didn't have an apparent illness or injury at the two conversations that took place in her apartment in Poughkeepsie," said Kyle Steinebach, prosecutor.

Kugler's defense team was not available for comment.

Judge Randall will make his ruling December 18th.

Kugler's trial is set to begin January 7th.
